Zion Plastic Surgery LLC (“Organization” or “Clinic”) is committed to helping you safeguard and adequately use your medical information. In order to provide all of our patients with the correct tools to protect their personal medical information, our Organization ensures the highest level of protection for your data. We only collect personal information from you that is provided to us with your express consent, and we collect no additional data. You have the right to revoke your authorization in writing at any time, which will restrict us from using your personal medical information for the purposes for which you withdraw your consent—all records of your medical care, whether this Policy covers current, past, or future. Please do note that all of your other healthcare providers, viz. doctors, labs, hospitals, and other similar providers, have their independent policies or notices governing the use and disclosure of your medical information and are not covered under this Policy.

As all personal medical information that you provide to us will solely be owned and used in a manner that has been disclosed to you, you also have certain rights to ensure the proper usage and disclosure of personal medical information:
1. Restrictions on Use
You have the right to request adequate restrictions on your personal health information usage or disclosure for any of our purposes. However, we may not always agree to your request if we are unable to comply due to any legal reasons. To the extent we can comply with your request, we will ensure compliance to the fullest extent feasible, except in emergencies when such restrictions may not be possible.

2. Amendment
You have the right to have us amend your personal medical information at any time if it is deemed to be incorrect or incomplete. However, only the healthcare entity or individual is authorized to amend your information. You may contact our office if you wish to make any amendment requests.

3. List of Disclosures
There may be certain circumstances under which we may be required to disclose your information, which is covered in the Disclosures section below. You have the right to request a list of all disclosures that we have made for purposes other than your treatment, and you may send us a request for this list at our office address. Your request cannot be made for a time period that is more than 6 years prior to the date of your request. If we provide physical copies of this list, you may be charged a nominal fee for the necessary charges incurred by us in providing you this list.

Our Organization collects your personal medical information to understand your needs and provide you with a better service and experience, and in particular, without limitation, for the following reasons: a) Internal record keeping. b) We may use the information to improve our products and services. c) We may periodically send promotional emails, newsletters, and other promotional marketing emails about new products, special offers or other information which we think you may find interesting using the email address which you have provided. DISCLOSURES

By availing of our Clinic’s services, you are giving your express consent to allow our Clinic to process, use and store personal medical information related to you that will be used for the purposes of your treatment and all other related matters like billing. In order to treat you to the best of our capacity, we will be required to disclose your personal medical information to our staff, which includes our in house doctors, medical personnel and administrative personnel. In addition, in order to allow you to have a more convenience experience for your treatment, we may also be required to share your personal medical information with third parties like your insurance provided in order to obtain payment for the services we will be providing you. In addition to the above, the following disclosures may be required to be made by us without requiring your prior authorization:

1. Disclosure to Other Individuals:

We may be required to disclose your personal medical information to a nominated member of your family, a relative, friend or guardian. If you are in a state where you may not be able to agree or disagree with such disclosure, we may disclose your information to such individuals based on our professional discretion and understanding.

2. Disclosure for Administrative Tasks (Limited):

We may be required to contact you at your residence or office based on the contact details you provide to us. During our interaction with a third party on such instances, we may be required to reveal basic details about your procedure to schedule the procedure you choose to undergo. However, this disclosure will not in any manner, include the specific details of your procedure. If you would like our Clinic to keep things further discreet and confidential and to not reveal any basic details either, please inform our representative to ensure complete confidentiality.

3. Disclosures Required by Law:

a) We may be bound to disclose your personal medical information if required under applicable federal, state or local law. This disclosure will only be made to the extent that is necessary under such applicable laws and will include information that is not required to be disclosed under such laws. If we are asked to make any such disclosures, you will be notified of such requests.

b) In addition, the Department of Health and Human Services has the right to scrutinize our operations in order to ensure that we are compliant with all applicable laws, which may require disclosure of your information as well.

c) Further, if any regulatory or oversight agencies, that are authorized by law, require us to disclose any information for their inspections, we will be required to disclose your personal medical information to such agencies. Usually these agencies conduct inspections to ensure that the healthcare industry is duly regulated and their work is only meant to benefit you, the end-user of our industry’s services.

d) We may also be required to report any instances of abuse, neglect or domestic violence to a government body authorized to receive such information, which will only be done in accordance with applicable Florida law.

e) Furthermore, if may have to disclose your personal medical information if you are involved in a lawsuit where we are bound under relevant legal procedures to comply with a court order or other lawful process. Your information may also warrant disclosure by a law enforcement official or authorized federal officials for the purposes of national interest.

b) We may disclose personal health information about you to a coroner or medical examiner for identification purposes, determining cause of death, or for the coroner or medical examiner to perform other duties required by law. We may also disclose personal health information about you to a funeral director in order to permit the funeral director to carry out legal duties, and may do so if death is reasonably anticipated. Your personal health information may also be disclosed for certain organ donations to which you may have agreed.
